Cahalan Photography — Terms of Service

Welcome to Cahalan Photography. These Terms of Service (“Terms”) govern the use of the Cahalan Photography website, photography galleries, digital photographs, products, and services provided by Cahalan Photography (“Cahalan Photography,” “we,” “us,” or “our”).

By accessing our website, purchasing photographs, downloading photographs, using a download code, or otherwise using our services, you acknowledge that you have read, understood, and agree to these Terms.

1. Photography Copyright

All photographs created and published by Cahalan Photography remain the intellectual property and copyrighted works of Cahalan Photography unless otherwise agreed to in writing.

Purchasing, downloading, or receiving a photograph does not transfer copyright ownership to the purchaser.

The purchaser receives a limited license to use purchased digital photographs for personal, non-commercial purposes, subject to these Terms.

Cahalan Photography retains all rights not expressly granted in these Terms.

2. Personal Use License

Unless a separate written license has been provided, purchased digital photographs may be used for personal purposes, including:

Posting on personal social media accounts
Sharing with friends and family
Printing photographs for personal use
Using photographs as personal profile or cover images
Saving photographs for personal records

When reasonably possible, crediting Cahalan Photography when posting photographs online is appreciated but is not required unless otherwise stated for a specific purchase or agreement.

3. Prohibited Uses

Without prior written permission from Cahalan Photography, purchased photographs may not be:

Sold, resold, licensed, or sublicensed
Used for commercial advertising or promotional purposes
Submitted to publications, media outlets, or businesses for commercial use
Used to promote a business, product, service, or organization
Altered, edited, filtered, or manipulated in a way that substantially changes the photograph or misrepresents the work of Cahalan Photography
Removed of copyright or photographer identification information when such information is embedded in the file
Distributed as a replacement for purchasing additional copies or downloads
Uploaded to stock photography websites or other platforms for redistribution

If you would like to use a photograph for commercial, promotional, editorial, or other purposes outside the personal-use license, please contact Cahalan Photography for permission and licensing options.

4. Digital Downloads

Digital photographs are provided electronically through our gallery and/or download system.

Once a photograph has been successfully downloaded, the purchaser is responsible for maintaining their own backup copy.

Cahalan Photography is not responsible for the loss of downloaded files resulting from device failure, accidental deletion, lost storage devices, account issues, or other circumstances outside our reasonable control.

If you experience a technical problem accessing a purchased gallery or download, please contact Cahalan Photography and we will make reasonable efforts to assist you.

5. Download Codes

Certain galleries may be provided with a download code that allows access to a specified number of photographs or unlimited downloads, depending on the applicable purchase or promotion.

Download codes are intended only for the individual or household to whom they were provided.

Do not share download codes with other individuals.

Cahalan Photography reserves the right to deactivate or replace a download code if there is evidence of unauthorized sharing, misuse, or abuse.

A download code does not transfer ownership or copyright of the photographs.

6. Pricing and Purchases

Prices for photographs, packages, galleries, and other services are displayed at the time of purchase.

Cahalan Photography reserves the right to change prices, packages, promotions, and availability at any time. Changes will not affect purchases that have already been completed unless otherwise required by law.

Promotional pricing, discount codes, seasonal pricing, and special offers may have additional terms or expiration dates stated at the time of the promotion.

7. Refunds and Digital Products

Because digital photographs can be accessed and downloaded electronically, completed digital purchases are generally non-refundable once the purchased photographs have been successfully delivered or downloaded.

If you believe you were charged incorrectly, received an incorrect product, or experienced a significant technical problem preventing access to a purchase, please contact Cahalan Photography as soon as reasonably possible so the issue can be reviewed.

Nothing in these Terms is intended to limit any refund, cancellation, or other rights that cannot legally be waived under applicable law.

8. Photo Availability

Cahalan Photography does not guarantee that every athlete, participant, moment, or activity at an event will be photographed.

Photography coverage may be affected by event schedules, weather, lighting, venue restrictions, equipment limitations, access restrictions, safety concerns, or circumstances outside the photographer's control.

The purchase of a package or season pass does not guarantee a specific number of photographs of any particular individual unless expressly stated in writing.

For sports photography, away-game coverage or additional events may be photographed at the photographer's discretion unless specifically included in a purchased package.

9. Season Passes and Packages

Season passes and photography packages apply only to the events, games, sports, locations, and coverage specifically stated in the applicable package description.

Unless otherwise stated, a package does not automatically include additional events, postseason events, tournaments, homecoming events, senior nights, away games, or other special events.

Any exclusions or additional charges stated in the applicable package or promotional material will apply to that purchase.

10. Website and Gallery Access

Cahalan Photography reserves the right to modify, suspend, or discontinue website features, galleries, or services when reasonably necessary.

Gallery availability may be limited by the applicable gallery expiration date or other terms provided at the time of purchase.

Users may not attempt to interfere with the operation of the website, circumvent access restrictions, obtain unauthorized access to galleries, or use technical methods to access photographs that they have not purchased or otherwise been authorized to access.

11. Third-Party Platforms

Cahalan Photography may use third-party services, including photography gallery, payment processing, hosting, and delivery platforms, to provide certain services.

Those services may have their own terms, privacy policies, and technical requirements. Cahalan Photography is not responsible for outages or technical failures caused solely by third-party services, although we will make reasonable efforts to assist customers when possible.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Cahalan Photography will not be responsible for indirect, incidental, special, consequential, or other damages arising from the use of the website, photographs, galleries, or services.

Cahalan Photography's total liability relating to a particular purchase or transaction will not exceed the amount actually paid by the customer for that particular purchase, except where a greater amount is required by applicable law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

13. Force Majeure

Cahalan Photography will not be responsible for failure or delay in providing services caused by circumstances beyond our reasonable control, including severe weather, natural disasters, illness, injury, equipment failure, venue restrictions, event cancellation, transportation problems, internet or technology failures, or other circumstances that could not reasonably be prevented.

If an event is canceled or photography becomes impossible for reasons outside our reasonable control, Cahalan Photography will communicate available options to affected customers.

14. Changes to These Terms

Cahalan Photography may update these Terms from time to time.

The updated Terms will become effective when posted on the website unless a different effective date is stated.

The Terms in effect at the time of a purchase will generally apply to that purchase, except where an update is required by law or necessary to address security, fraud, or other operational concerns.

15. Governing Law

These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law principles, except to the extent applicable federal law provides otherwise.

Any dispute will be handled in accordance with applicable Iowa and federal law.

16. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in effect.

17. Entire Agreement

These Terms, together with any applicable written agreement, purchase terms, package description, or other terms expressly incorporated into a transaction, constitute the agreement between the customer and Cahalan Photography regarding the applicable purchase or service.

If a separate written agreement conflicts with these Terms, the separate written agreement will control for that specific transaction.
